1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of CloudMySite websites, applications, dashboards, APIs, hosting services, AI tools, newsletter tools, forms, support services, documentation, and related products and services (collectively, the "Services").
By creating an account, accessing a dashboard, purchasing a plan, publishing a site, sending a newsletter, using AI generation features, uploading content, or otherwise using the Services, you agree to these Terms and to any product-specific rules, order forms, invoices, plan limits, and policies referenced in these Terms.
If you are using the Services on behalf of a business, organization, or other entity, you represent that you have authority to bind that entity. In that case, "you" and "your" refer to both you and that entity.
If you do not agree to these Terms, do not use the Services.
2. Services Covered
These Terms apply to all CloudMySite services, including but not limited to:
- cloudmysite.com company website, dashboard, billing, account management, hosting products, support, and product pages.
- cloudmysite.ai AI Studio, AI Website Builder, Website Genie, AI logo generator, AI favicon generator, AI-assisted website/content creation, and related handoff workflows.
- newsletter.cloudmysite.com newsletter publishing, subscriber management, campaigns, imports, automations, forms, unsubscribe pages, recommendations, referrals, monetization features, custom sender domains, and email delivery features.
- docs.cloudmysite.com product documentation, guides, API documentation, and educational material.
- support.cloudmysite.com ticketing, customer support, bug reporting, service requests, and related communications.
- Hosting and deployment features, including static sites, uploaded sites, custom domains, Cloudflare Pages/deployment workflows, DNS-related guidance, R2/static asset hosting, APIs, Workers, KV/D1-backed application data, and future product modules.
Product names, URLs, features, availability, and plan limits may change over time.
3. Account Eligibility and Registration
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or purchase Services. The Services are not intended for children under 13.
You agree to provide accurate, current, and complete registration, billing, contact, and business information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account, workspace, API keys, access tokens, and integrations.
You must promptly notify CloudMySite if you believe your account or credentials have been compromised.
4. Workspaces, Ownership, Roles, and Teams
CloudMySite may organize Services through workspaces, publications, projects, sites, stores, campaigns, repositories, or similar containers.
The person or entity designated as the workspace owner or billing owner is treated as the primary owner of that workspace and its associated sites, campaigns, subscriber data, billing settings, and team access unless CloudMySite determines otherwise based on records, payment history, domain ownership, written agreements, or other reliable evidence.
You may invite team members, developers, contractors, or collaborators to help build or manage a site, newsletter, store, or other project. You are responsible for:
- Selecting appropriate roles and permissions.
- Monitoring team member activity.
- Removing access when a person no longer needs it.
- Ensuring contractors and team members comply with these Terms.
A developer, agency, employee, contractor, or other invited team member does not become the owner of a workspace merely by building or editing the site. Ownership remains with the designated owner or the entity that controls the account/billing relationship, unless the parties provide CloudMySite with clear written instructions or legally binding documentation.
CloudMySite may support roles such as owner, admin, editor, developer, viewer, billing admin, support viewer, or other custom roles. Role names and permissions may change as the product evolves.
5. CloudMySite Administrative Access
CloudMySite personnel and authorized systems may access account, workspace, site, campaign, subscriber, form, and usage data when reasonably necessary to:
- Provide support.
- Investigate bugs or security incidents.
- Prevent abuse, fraud, spam, phishing, malware, unauthorized access, or violations of these Terms.
- Maintain, improve, debug, secure, and operate the Services.
- Enforce plan limits, billing rules, email sending reputation protections, and acceptable use restrictions.
- Comply with law, court orders, subpoenas, law enforcement requests, or other legal obligations.
- Identify abandoned, unused, or resource-heavy projects that may be suspended, archived, or deleted under these Terms.
CloudMySite may provide internal superadmin or support-viewer access to authorized personnel. Such access should be logged where technically feasible and limited to legitimate business, security, support, compliance, or abuse-prevention purposes.
6. User Content and Customer Data
"User Content" means content, files, websites, code, text, images, prompts, subscriber lists, campaigns, forms, logos, domains, DNS settings, templates, products, store content, metadata, and other materials that you upload, create, submit, import, publish, transmit, or store using the Services.
You retain ownership of your User Content. You grant CloudMySite a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, publish, modify, and otherwise use your User Content only as necessary to provide, secure, support, operate, improve, and enforce the Services.
You represent and warrant that you have all rights, permissions, licenses, notices, and consents necessary to upload, use, publish, send, import, or process your User Content.
You are solely responsible for your User Content, including its legality, accuracy, quality, intellectual property rights, privacy compliance, data protection compliance, and any claims arising from it.
7. AI Studio, Website Genie, and AI-Generated Content
CloudMySite may provide AI-assisted tools to help generate websites, pages, logos, favicons, copy, images, layouts, newsletter drafts, unsubscribe pages, product descriptions, marketing content, or other output.
You are responsible for reviewing, editing, approving, and validating AI-generated content before publishing or using it. AI-generated content may be inaccurate, incomplete, similar to other content, offensive, outdated, noncompliant, or unsuitable for your business.
CloudMySite does not guarantee that AI-generated output is unique, accurate, non-infringing, compliant, commercially suitable, or free from third-party claims. You must not use AI features to generate illegal, harmful, deceptive, infringing, abusive, discriminatory, sexually exploitative, violent, spam, phishing, impersonation, or malware-related content.
AI features may use third-party model, image, cloud, inference, moderation, storage, or processing providers. Your prompts, inputs, uploaded files, metadata, generated output, and related context may be processed by those providers as necessary to provide the Services, subject to the Privacy Policy and any applicable Data Processing Addendum.
CloudMySite may restrict, refuse, suspend, remove, or disable AI-generated content or accounts that violate these Terms, applicable law, third-party provider rules, or CloudMySite policies.
8. Hosting, Websites, Static Uploads, and Deployment
CloudMySite may provide hosting, deployment, static site upload, website builder, custom domain, content delivery, and related features. You are responsible for ensuring that your website content, uploaded files, code, assets, forms, scripts, integrations, and published pages comply with law and do not violate third-party rights.
You may not use CloudMySite hosting to host or distribute malware, phishing pages, credential harvesting, botnets, command-and-control infrastructure, spam landing pages, deceptive forms, illegal goods or services, pirated material, child sexual abuse material, non-consensual intimate content, terrorist/extremist content, hate or harassment content, or other abusive or unlawful content.
CloudMySite may scan, block, quarantine, suspend, remove, rate limit, or disable content, sites, deployments, accounts, or traffic when necessary to protect users, CloudMySite, infrastructure providers, email reputation, security, or the public.
9. Domains, DNS, Custom Domains, and Email Sender Domains
CloudMySite may help you connect custom domains, subdomains, DNS records, SSL/TLS certificates, Pages deployments, static sites, email sender domains, and related services. You are responsible for owning or controlling any domain you connect to the Services.
CloudMySite is not responsible for domain registrar errors, DNS propagation delays, third-party DNS provider issues, nameserver configuration errors, certificate issuance delays, domain disputes, trademark disputes, expired domains, or loss of domain ownership.
If CloudMySite provides domain registration or transfer assistance in the future, domain purchases, renewals, transfers, redemption fees, registry fees, and third-party domain charges are generally non-refundable unless required by law or expressly stated otherwise.
For custom sender domains, you are responsible for publishing required DNS records, maintaining accurate sender identity, complying with email laws, protecting your sending reputation, and ensuring your campaigns are authorized.
10. Newsletter, Email Marketing, and Subscriber Data
CloudMySite Newsletter tools may allow you to collect subscribers, import CSV/TSV files, segment audiences, design forms, send campaigns, create automations, run referral or recommendation programs, monetize newsletters, manage unsubscribe pages, use custom sender domains, and view analytics.
You are the controller/business owner of subscriber data you upload, import, collect, or manage through the newsletter tools. CloudMySite acts as your service provider/processor for such subscriber data when processing it on your behalf to provide the Services.
You represent and warrant that:
- You have valid permission, consent, or another lawful basis to email each subscriber.
- You will not upload purchased, rented, scraped, harvested, guessed, or unauthorized lists.
- You will not send spam, phishing, malware, deceptive promotions, unlawful content, or misleading commercial messages.
- You will include accurate sender identity and required business/contact information where applicable.
- You will honor unsubscribe requests and suppression lists.
- You will comply with CAN-SPAM, CASL, GDPR/ePrivacy, UK GDPR/PECR, CCPA/CPRA, TDPSA, and other laws that apply to your campaigns and subscribers.
CloudMySite may suspend or limit email sending, imports, automations, domains, or accounts due to spam complaints, bounce rates, abuse reports, third-party provider limits, reputation risk, provider suspension, legal complaints, suspicious imports, or suspected policy violations.
CloudMySite may require additional verification before allowing bulk sending, custom sender domains, higher volume limits, or monetization features.
11. Forms, Turnstile, Honeypot, Leads, and Submissions
CloudMySite may provide form builders, form APIs, Turnstile/CAPTCHA integrations, honeypot protection, lead capture, contact forms, newsletter forms, unsubscribe preference forms, and related features.
You are responsible for the forms you publish and for providing required notices, consents, privacy disclosures, opt-in language, and lawful basis for collecting personal data through those forms.
You must not use forms to collect sensitive personal data, payment card data, government IDs, passwords, health data, children's data, or other highly sensitive information unless your plan and configuration are expressly designed for that use and you have all required legal permissions and security controls.
CloudMySite may block, rate limit, quarantine, or delete form submissions that appear to be spam, malicious, fraudulent, abusive, or unlawful.
12. E-Commerce, Shopping Features, Products, and Customer Stores
CloudMySite may offer templates, tools, integrations, or hosting that enable customers to create shopping pages, product pages, order forms, checkout integrations, shipping pages, digital product pages, or similar commerce experiences.
Unless CloudMySite expressly states that it is the seller of record for a particular item, you are the seller of record for goods or services sold through your website or store. You are responsible for:
- Product descriptions, pricing, taxes, shipping, delivery, returns, refunds, warranties, and customer service.
- Compliance with consumer protection, advertising, tax, product safety, export, import, and industry-specific laws.
- Posting your own store terms, privacy policy, return policy, shipping policy, and contact information.
- Handling disputes, chargebacks, fraud, returns, damaged items, and order fulfillment.
CloudMySite is not responsible for products or services sold by customers using CloudMySite-hosted sites, except to the extent CloudMySite is expressly identified as seller of record.
13. CloudMySite Direct Purchases, Returns, and Refunds
This section applies to purchases made directly from CloudMySite.
13.1 Digital Services and Subscriptions
CloudMySite's hosting, AI tools, newsletter tools, domains, templates, email sending, support plans, storage, add-ons, credits, setup work, and other digital services are generally non-returnable once provisioned or used.
If CloudMySite offers a 30-day money-back guarantee for a specific plan, the guarantee applies only to the eligible first purchase of that plan and does not apply to:
- Domain registrations, renewals, transfers, redemption fees, or third-party registry fees.
- Email sending fees, email validation fees, SMS or communication usage fees, AI/image generation credits, storage overages, bandwidth overages, or metered usage.
- Custom setup, migration, development, design, consulting, or professional services.
- Add-ons or third-party services purchased through or connected to CloudMySite.
- Accounts suspended for abuse, spam, fraud, chargebacks, illegal content, or Terms violations.
- Renewals unless required by applicable law or expressly stated in the order.
Refunds, when approved, are issued to the original payment method where possible and may take time depending on the payment processor and bank.
13.2 Physical Products Sold Directly by CloudMySite
If CloudMySite sells physical products or merchandise directly, those items may be returned within TODO_RETURN_WINDOW_DAYS days after delivery if unused, undamaged, and returned with original packaging, unless the product page states otherwise.
Customers must request a return authorization before sending products back. Customers are responsible for return shipping unless the item was defective, damaged on arrival, or the wrong item was shipped.
Certain items are final sale, including customized items, digital downloads, used items, clearance items, gift cards, and items marked final sale.
If CloudMySite cannot ship merchandise within the promised time, or within 30 days if no time is stated, CloudMySite will provide delay/cancellation options and refunds as required by applicable law.
13.3 Chargebacks
If you initiate a chargeback or payment dispute, CloudMySite may suspend the affected Services while the dispute is investigated. You remain responsible for valid charges, taxes, fees, and costs associated with chargebacks or collections where permitted by law.
14. Plans, Billing, Automatic Renewal, and Taxes
Plan features, quotas, prices, trial periods, storage, bandwidth, subscribers, AI credits, email sending limits, team seats, workspaces, domains, support levels, and other limits are shown in the applicable plan page, order form, invoice, or dashboard.
Unless stated otherwise, paid subscriptions renew automatically until canceled. You authorize CloudMySite and its payment processor to charge your payment method for recurring fees, usage fees, taxes, and applicable charges.
You may cancel future renewals through your account settings where available or by contacting support. Cancellation stops future renewals but does not automatically refund past charges unless required by law or stated in a specific refund policy.
CloudMySite may change prices or plan features by providing notice through the dashboard, email, website, invoice, or other reasonable means. Price changes generally apply at the next renewal unless otherwise stated.
You are responsible for taxes, duties, levies, or similar charges, except taxes based on CloudMySite's income.
15. Support, Documentation, and Professional Services
CloudMySite may provide support by ticket, email, chat, phone, dashboard, documentation, or other channels. Support availability, response times, scope, and priority may depend on your plan.
Documentation, samples, scripts, prompts, code snippets, DNS guidance, setup steps, and AI-generated assistance are provided for convenience and may be incomplete, outdated, or require adjustment for your environment.
Professional services, custom design, development, migration, consulting, or implementation work may require a separate statement of work, invoice, or agreement.
16. APIs, Integrations, Tokens, and Automation
You are responsible for securing API keys, access tokens, OAuth connections, webhooks, repositories, environment variables, deployment secrets, and third-party credentials. You must not share secrets publicly or embed credentials in client-side code.
CloudMySite may rate limit, suspend, rotate, revoke, or block API access or integrations to protect security, performance, reputation, infrastructure, or other users.
You are responsible for third-party integrations you connect, including GitHub, Cloudflare, AWS, payment processors, analytics, email providers, DNS providers, AI providers, and customer systems.
17. Resource Limits, Fair Use, and Service Availability
CloudMySite may enforce limits on storage, bandwidth, CPU, memory, requests, subscribers, imports, campaigns, AI generations, images, repositories, builds, deployments, API calls, form submissions, and email sending.
Unlimited or high-volume features are subject to fair use and may not be used in a way that harms service performance, email reputation, security, infrastructure, or other customers.
CloudMySite does not guarantee uninterrupted, error-free, or secure operation. Maintenance, provider outages, DNS propagation, third-party limits, network attacks, bugs, or force majeure events may affect availability.
Any service level commitments apply only if expressly stated in a separate SLA or order form.
18. Backups, Data Export, and Inactive Accounts
You are responsible for maintaining your own backups of important content, sites, data, subscriber lists, source files, DNS records, designs, and configurations.
CloudMySite may provide backup, export, restore, version history, or repository features, but does not guarantee that all data can be recovered.
CloudMySite may archive, suspend, or delete inactive free accounts, trial accounts, unused apps, abandoned sites, old builds, unused generated assets, or unpaid resources after reasonable notice where feasible. For MVP policy, use:
- Free or trial projects inactive for 6 months may be archived or deleted.
- Paid accounts with unpaid invoices may be suspended and later deleted after notice.
- Abusive, illegal, or security-risk content may be removed immediately without notice.
19. Acceptable Use Policy
You may not use the Services to:
- Violate any law, regulation, court order, or third-party right.
- Send spam, unauthorized marketing, phishing, malware, deceptive email, or credential harvesting campaigns.
- Host malware, ransomware, command-and-control infrastructure, botnets, proxy abuse, vulnerability scanning without authorization, or attack tools.
- Infringe copyright, trademark, patent, trade secret, privacy, publicity, or other rights.
- Impersonate others or misrepresent affiliation, sender identity, product claims, testimonials, endorsements, or business identity.
- Collect, process, or disclose personal data unlawfully.
- Publish hate, harassment, threats, doxxing, non-consensual intimate content, child sexual abuse material, terrorist/extremist content, or content that promotes violence or exploitation.
- Sell illegal or highly regulated goods or services without required approvals, including controlled substances, weapons, counterfeit goods, stolen goods, illegal financial products, or unlawful gambling.
- Abuse trials, credits, promotions, referrals, affiliate programs, or plan limits.
- Interfere with CloudMySite infrastructure, networks, provider accounts, reputation, or other users.
CloudMySite may investigate, remove, suspend, report, or preserve content and account data when necessary to enforce this policy.
20. Intellectual Property
CloudMySite owns or licenses the Services, software, designs, templates, workflows, documentation, dashboards, APIs, branding, trademarks, icons, and technology used to provide the Services.
You may not copy, reverse engineer, resell, modify, exploit, or create derivative works from CloudMySite software or materials except as expressly allowed by CloudMySite.
You retain rights in your User Content. CloudMySite may use your name, logo, or public website as a customer reference only with your consent or where you make it publicly available and such use is allowed by law. You may ask CloudMySite to stop using your public logo/reference for marketing.
21. Copyright Complaints and DMCA Process
If you believe content hosted by CloudMySite infringes your copyright, send a notice to CloudMySite's designated copyright agent.
Your notice should include:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the allegedly infringing material and information reasonably sufficient for CloudMySite to locate it.
- Your contact information.
- A statement that you have a good-faith belief the use is not authorized.
- A statement under penalty of perjury that the information is accurate and that you are authorized to act.
CloudMySite may remove or disable access to allegedly infringing material and may terminate repeat infringers. If you receive a takedown notice and believe it was mistaken, you may submit a counter-notice as permitted by law.
CloudMySite should register and maintain a DMCA designated agent with the U.S. Copyright Office if it hosts user-generated content and wants to preserve available safe harbor protections.
22. Third-Party Services and Providers
The Services may depend on third-party services such as cloud infrastructure, DNS, CDN, domain registrars, payment processors, email delivery providers, AI providers, analytics tools, support tools, repositories, authentication providers, app stores, and customer-selected integrations.
CloudMySite is not responsible for third-party service outages, limitations, errors, pricing changes, policy changes, data handling, suspensions, or security incidents outside CloudMySite's control.
Your use of third-party services may be subject to separate terms and policies.
23. Beta, Preview, and Experimental Features
CloudMySite may release beta, preview, experimental, early access, or limited availability features. These features may be unstable, incomplete, discontinued, changed without notice, subject to additional restrictions, or excluded from support or SLAs.
You should not rely on beta features for mission-critical production use unless CloudMySite expressly states otherwise.
24. Suspension and Termination
CloudMySite may suspend, limit, or terminate Services if:
- You violate these Terms or applicable law.
- Payment fails or invoices remain unpaid.
- Your account causes security, abuse, spam, phishing, malware, infrastructure, or email reputation risk.
- Required verification is not completed.
- Third-party providers suspend or limit related services.
- Your use creates legal, regulatory, or operational risk for CloudMySite.
You may stop using the Services or cancel subscriptions at any time. Termination does not relieve you of payment obligations incurred before termination.
After termination, CloudMySite may delete data according to its retention policies, except where retention is required for legal, security, billing, dispute, backup, or compliance purposes.
25. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, CloudMySite disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and uninterrupted operation.
CloudMySite does not guarantee that the Services, AI outputs, documentation, support responses, third-party integrations, DNS changes, email deliverability, search rankings, conversions, revenue, or business outcomes will meet your expectations.
26. Limitation of Liability
To the fullest extent permitted by law, CloudMySite will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, revenue, goodwill, business opportunity, reputation, or anticipated savings.
CloudMySite's total liability for all claims arising out of or relating to the Services will not exceed the greater of: (a) the amount you paid to CloudMySite for the affected Service during the 12 months before the event giving rise to the claim; or (b) USD $100.
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
27. Indemnification
You agree to defend, indemnify, and hold harmless CloudMySite, its owners, officers, employees, contractors, affiliates, providers, and agents from claims, damages, liabilities, penalties, fines, costs, and expenses arising from:
- Your User Content.
- Your websites, newsletters, stores, forms, campaigns, products, or services.
- Your violation of these Terms or law.
- Your infringement or alleged infringement of third-party rights.
- Your subscribers, customers, visitors, employees, contractors, or team members.
- Your misuse of email sending, AI features, domains, APIs, credentials, or integrations.
28. Governing Law and Disputes
These Terms are governed by the laws of TODO_STATE, without regard to conflict-of-law rules, unless applicable law requires otherwise.
Before filing a claim, you agree to contact CloudMySite and attempt to resolve the dispute informally. If the dispute cannot be resolved, disputes will be handled in the state or federal courts located in TODO_COUNTY, TODO_STATE, unless a separate arbitration agreement or applicable law requires a different forum.
Consider attorney review before adding mandatory arbitration, class-action waiver, jury waiver, or consumer-specific dispute clauses.
29. Changes to Terms
CloudMySite may update these Terms from time to time. Updated Terms will be posted on the legal page with a new effective date. CloudMySite may also notify you through email, dashboard notices, billing notices, or other reasonable means.
Your continued use of the Services after the effective date of updated Terms means you accept the updated Terms.
